• Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
• Source of collection: collected from you.
• Disclosure for a business purpose: shared with our processor Shopify, Facebook, Paypal. 

Minors

The Site is not intended for individuals under the age of 13 years of age. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

Retention

Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We [DO NOT] engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

• Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
• Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

Selling Personal Information

Our Website may gather Personal Information, as defined by the California Consumer Privacy Act of 2018 (“CCPA”). For purposes of the CCPA, Get Pesty does not “sell” your personal information. 

In accordance with applicable law, you may have the right to: (i) request confirmation of whether we are processing your Personal Information; (ii) obtain access to or a copy of your Personal Information; (iii) receive an electronic copy of Personal Information that you have provided to us, or ask us to send that information to another company (the “right of data portability”); (iv) object to or restrict our uses of your Personal Information; (v) seek correction or amendment of inaccurate, untrue, incomplete, or improperly processed Personal Information; (vi) withdraw your consent; and (vii) request erasure of Personal Information held about you by Get Pesty, subject to certain exceptions prescribed by law.

If you would like to exercise any of these rights, please contact us as set forth below. We will process such requests in accordance with applicable laws. To protect your privacy, we will take steps to verify your identity before fulfilling your request.

If you are a California resident, you have the right not to receive discriminatory treatment by Get Pesty for the exercise of your rights conferred by the California Consumer Privacy Act.

How to Opt Out

We want to make sure that you are comfortable with the way we are collecting, processing, and using your Personal Information, so we want to make sure we give you clarity of the various ways you can control how this information is used. Please note, however, that by opting out of any of these methods, you may be limited in your ability to access certain services, rewards, gifts and offers based on your exclusion.

If you do not want to be on our list, you can unsubscribe at the bottom of every email. If you are still not unsubscribed, that is an error, and please email us at info@getpesty.com. Note that you will continue to receive transaction-related emails regarding products or services you have requested, and other service-related, non-promotional emails.

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States.
